Workers’ Compensation & Social Security Disability Questions

At The Pearson Law Firm in Oxford, MS, addressing our clients’ and potential clients’ concerns is a large part of our role as attorneys. Look over the following questions and answers about work injuries, disabilities and more. Then, let us know what is on your mind.

  • Can I pursue legal action against my employer following a workplace injury?

Typically, no. However, there may be an option to file a third-party liability claim against someone other than your employer. This legal action would be separate from your workers’ compensation claim.

  • What benefits are available if I sustain an injury outside of work?

If your injury occurred while conducting work-related duties away from your workplace, you likely qualify for workers' compensation benefits. In cases where your injury is unrelated to work, you may consider filing a personal injury claim or utilizing your personal health insurance coverage. Regardless of the circumstances of your injury, if you anticipate being unable to work for a year or more due to disabilities, you may qualify for Social Security Disability (SSD) benefits.

  • What should I do if my benefits claim is rejected?

If the workers’ compensation insurance carrier denies your claim for benefits, your workers’ compensation attorney may present additional evidence in a hearing before an administrative law judge (ALJ), and if necessary, file appeals to the full Mississippi Workers’ Compensation and the Mississippi state appellate courts.

If your application for disability benefits is denied by Social Security, our SSD attorney can assist you with:

    • Requesting reconsideration of your application
    • Scheduling a hearing before an SSD ALJ
    • Seeking a review by the Social Security Appeals Council
    • Pursuing an appeal through a federal court

If you find yourself unable to return to work due to an injury or disability, seeking legal guidance is advisable.

  • Do I need a lawyer to file a benefits claim?

While legal representation is not mandatory to file a claim or apply for benefits, you may require a lawyer's assistance if:

    • Your workers' compensation insurance carrier denies coverage for essential medical treatments.
    • Your workers' comp benefits are terminated before you can return to work.
    • Social Security rejects your benefits application despite your inability to work for a year or longer.
    • Social Security initiates but then discontinues payments for any reason.

We look forward to explaining how we can help you obtain the workers’ comp or SSD benefits you deserve. Call (662) 238-3339.
